These Terms of Service ("Terms") govern your use of the website and services offered by The Summerland LLC ("The Summerland," "we," "us," or "our"), located at 4411 California Ave SW, Suite 100, Seattle, WA. By using our website, booking a yoga class, booking a hair appointment, or visiting our studio, you agree to these Terms.
1. Our Services
The Summerland offers yoga classes and hair services. Yoga classes are booked and paid for through Mariana Tek. Hair appointments are booked and paid for through Square. Class and appointment availability, pricing, and schedules are subject to change at our discretion and will be reflected on our booking platforms.
## 2. Yoga: Class Timing and Late Arrivals Yoga classes begin promptly at the time listed, and doors are locked at start. No late arrivals are permitted into the space, regardless of how minor the delay. This policy honors the yogic principle of Asteya (non-stealing) — respecting the time, energy, and presence of everyone in the room. If you arrive after class has started, you will not be admitted and will be subject to the cancellation policy below.
## 3. Yoga: Cancellations and Credits You may cancel or reschedule a yoga class up to 3 hours before the scheduled start time without penalty. Canceling less than 3 hours before class, or failing to show up, is considered a late cancellation and results in loss of the class credit. Current fees and pricing-plan-specific terms (including no-show and late-cancellation fees) are listed in your Mariana Tek account and at the time of booking, and may be updated from time to time. This policy helps us keep classes running smoothly and available to the whole community.
4. Hair Services: Late Arrivals, Cancellations, and Rescheduling
Hair appointments are booked and paid for through Square.
Late arrivals:A 15-minute grace period is provided for haircut appointments. After 15 minutes, your appointment may need to be rescheduled, and a fee may be charged.
Cancellations and rescheduling:We require at least 24 hours' notice to cancel or reschedule a hair appointment. Appointments changed or canceled within 24 hours of the scheduled time will be charged 50% of the service total. No-shows are charged in full.
We understand that unexpected circumstances arise. If something comes up, please reach out directly — extenuating circumstances will be considered on a case-by-case basis.
5. Yoga: Assumption of Risk and Release of Liability
By checking the box to accept these Terms and/or signing the separate liability waiver provided at booking, you agree to the following with respect to yoga, movement, sound, meditation, and related practices offered at The Summerland:
Assumption of Risk. You understand that these activities may involve physical activity that carries inherent risks of injury, including but not limited to muscle strain, sprains, falls, or, in rare cases, more serious injury. You voluntarily participate with full awareness of these risks and accept personal responsibility for your safety.
Health & Medical Conditions. You affirm that you are in good physical condition and capable of participating in yoga and related activities. You agree to disclose to instructors any health concerns or injuries that may affect your participation, to listen to your body, to modify or refrain from movements as needed, and to consult a physician if unsure.
Consent to Touch / Adjustments.
Some instructors may offer optional hands-on adjustments or supportive touch during practice. You acknowledge that you have the right to decline or revoke consent to touch at any time, verbally or nonverbally, and instructors will honor that immediately. Consent is never assumed and is always your choice; participation in class does not require receiving physical adjustments.
Release of Liability.
In consideration of being permitted to participate, you knowingly and voluntarily release, waive, and discharge The Summerland LLC, its owner(s), instructors, staff, and affiliates from any and all liability, claims, demands, actions, or causes of action — including those arising from ordinary negligence — that may result in injury, illness, property loss, or death during or after participation in classes, workshops, events, or use of facilities.
Communicable Diseases.
You acknowledge that participation may expose you to illness, including but not limited to COVID-19 and other communicable diseases, and you voluntarily assume all risks related to such exposure.
Personal Responsibility.
You are responsible for practicing within your personal limits and for the safekeeping of your own belongings while on studio premises, and agree to follow all studio policies and instructor directions.
Photo & Media Release (optional).
Photos or videos may occasionally be taken during classes or events for community and marketing purposes. By accepting these Terms, you grant The Summerland permission to use your likeness in such materials. You may opt out at any time by notifying staff in writing.
Minors.
By accepting these Terms, you affirm that you are at least 18 years of age. If accepting on behalf of a minor, you certify that you are their parent or legal guardian and consent to their participation under these terms. A separate liability waiver is also presented and signed at the time of your first yoga booking through Mariana Tek. Both documents are binding; in the event of any conflict between them, the more protective term for The Summerland shall govern.
6. Hair Services The Summerland's hair services are separate from yoga and are not covered by the yoga liability waiver. No liability waiver is required for hair services. Clients are responsible for communicating any allergies, sensitivities, or relevant health information to their stylist prior to service. The Summerland does not perform chemical services.
7. Health Disclaimer The Summerland is a wellness and beauty studio. Nothing offered — including yoga instruction or hair services — constitutes medical advice, diagnosis, or treatment. Always consult a licensed physician before beginning any new physical activity, especially if you are pregnant, recovering from injury, or managing a medical condition.
8. Studio Conduct, Guests, and Pets - Treat instructors, stylists, staff, and fellow clients with respect, and follow studio etiquette. - Hair services are offered privately. Guests or children are welcome at a hair appointment if that suits your experience; the studio is not child-proofed, so please ensure they are well-behaved and supervised. - This is not a pet-friendly space. Only trained service animals performing a task for a disability are permitted under ADA guidelines. Emotional support animals and therapy pets are not recognized under this policy and cannot be accommodated. - We reserve the right to refuse service or class attendance to anyone who violates these standards.
9. Personal Property
The Summerland is not responsible for lost, stolen, or damaged personal property brought onto the premises.
10. Website Use
When using our website, you agree not to:
Use it for any unlawful purpose
Attempt to disrupt, hack, or interfere with its operation
Copy, reproduce, or redistribute our content (including class descriptions, photos, and branding) without permission
All content on our website — including logos, photos, and class/service descriptions — is the property of The Summerland LLC unless otherwise credited.
11. Third-Party Platforms
Yoga bookings, payments, and liability waivers are processed through Mariana Tek. Hair service bookings and payments are processed through Square. Your use of those platforms is also subject to their own terms and privacy policies. The Summerland is not responsible for the practices or availability of third-party platforms.
12. Limitation of Liability
To the fullest extent permitted by law, The Summerland LLC and its owner, employees, and contractors shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or services.
13. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in King County, Washington.
14. Changes to These Terms
We may update these Terms from time to time, including changes to cancellation policies, pricing, or fees, which will be reflected on our website and booking platforms. The "Last Updated" date above reflects the most recent revision. Continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms.
15. SMS Messaging Terms
